New Visas Resolution in Colombia, what do you need to know?

Over the years, countries update their immigration regulations to update visa categories according to new agreements, needs, or requirements.

This year Colombia has updated its visa resolution, with resolution number 5547 of 2022 coming into effect on October 21st of this year.

How can the changes of the new resolution affect you?

We recommend you to consider the following:

  1. If you are the parent of a Colombian national, the new visa category for which you may apply is the Migrant visa - Parent of a Colombian national. After having this visa category for at least 2 years, you will be able to apply for the resident visa.

  2. If you are the spouse of a Colombian national (if your marriage is registered in a notary's office), you may apply for a Colombian national spouse visa. After 3 years with this visa category, you will be able to apply for a resident visa.

  3. If you are not married, but only have a common-law marriage registered at the notary's office, you will have to wait at least 1 year to be able to apply for the visa of permanent partner of a Colombian national. After 3 years with this visa category, you will be able to apply for a resident visa.

  4. If your interest is to work in Colombia and accumulate time for residency, it will be necessary to check if, due to your nationality, you can apply for a visa that allows you to exercise remunerated activities in the country. The countries with an agreement in force are Ecuador, Peru, Bolivia, Uruguay, Chile*, Argentina and Brazil. Otherwise, it would be necessary to consider whether both you and the hiring company meet the requirements to apply for a migrant-worker visa.

  5. If your intention is not to accumulate time for residency, or maybe you do but do not meet the conditions at the moment, there are some visas in the visitor category that may interest you, such as the Digital Nomad visa or the Student visa, which now allows a certain number of hours to exercise paid activity in the country.

  6. If you have been in Colombia with a Migrant visa, continuously and uninterruptedly, you will be able to apply for Residency. Depending on your nationality, you will be able to apply for Colombian nationality after 1 to 5 years with a Resident visa.

  7. For Venezuelan nationals who applied for the temporary protection status, they will be able to apply for the Resident visa after 5 continuous years under the migratory quality granted by the status.

This new immigration status has many interesting options! If you are interested in finding out more about any subcategory, we invite you to contact us and we will gladly analyze your case individually.

*Although Chile is mentioned as part of the Mercosur agreement, it is necessary to review whether this will be effective or whether this nationality will be annulled, as happened with the previous resolution.
