Colombia has become not only a tourist destination but also a country of interest for many foreigners who want to migrate and start a new life. In this process of relocation to our country it is normal for families to start or continue to grow, but some important questions come to the homes of these foreigners when they have children in Colombian territory: What about my child? Does he/she become Colombian/a automatically? Does he/she lose their current nationality? Will they have a double nationality?
In today’s section we help you resolve all these concerns. Let’s start:
The first thing to keep in mind is that, Colombian nationality is not obtained directly by being born in Colombian territory in the case of foreigners. For a newborn to be considered Colombian, it must meet 2 of the following conditions:
1. That one of the parents is Colombian.
2. That the parents intend to be domiciled in Colombia.
3. To have been born in Colombian territory.
According to the above, options 1 and 2 are clear, but for the second requirement how does a foreigner demonstrate the intention of domicile in Colombia? This intention is demonstrated through the type of visa that parents have at birth, for example, if the child is born in Colombia and his/her parents have a tourist visa, with this visa the intention to live in Colombia is not demonstrated. On the contrary, if the parents have a work visa, Mercosur or resident, for example, these types of visas demonstrate the intention to stay in Colombia and establish their domicile in the country, so in the birth register they will be given a note that reads "Valid to prove nationality" and with it the parents can register the child as Colombian.
However, it is very important to bear in mind that, if the requirements for registering the child as a Colombian/a are met, it is used first with the consulate of the country of origin if there will be no problem with the dual nationality of the child, because there are some countries that, do not allow more than one nationality, so it is always advisable to validate the relevant regulation before taking any decision.
Finally, if the parents decide not to register/a as Colombian/a, even if he/she meets the conditions, the process to follow is to obtain a visa for the child that usually is of the type beneficiary of the visa of some of the parents.
